The Ontario Superior Court of Justice has granted another extension until November 20, 2025, for the federal government to amend the unconstitutional First-Generation Limit (FGL) in the Citizenship Act. Judge Jasmine Akbarali’s decision comes despite acknowledging the ongoing hardships faced by affected individuals. The FGL, which prevents children of citizens by descent from obtaining Canadian citizenship, was ruled unconstitutional in December 2023. While interim measures allow affected individuals to apply for discretionary citizenship grants, the incoming government, after the April 28 election, must prioritize new legislation within the eight-month timeframe.
